Legal Question in Workers Comp in California

Worker's Comp.

I injured my shoulder on the job. When I went to the wc doc they said I was able to do lite duty. I am now suppose to show up for work tomorrow but I am still in alot of pain and don't agree with their dx. If I quit I was told I lose my wc. What do you suggest I do?

Re: Worker's Comp.

I recommend that you don't quit. You can request to see another doctor and you need to immediately inform your employer of the appointment and if there is a MPN(Medical Network Provider) then get a list and choose a different doctor. If you decide to show up to work, and you can't do the light duty work immidiately report that to your employer that you need to see a doctor regarding your pain and aggravation of your injury and ask him to send you to doctor. In any case, Call my office at 213.388.7070 for a free consultation of your case.

Re: Worker's Comp.

The employer must first offer light duty. It makes little sense to worry about going back to work if the employer has not light duty work.

You should probably file and applicagtion for adjudication of claim and make certain your wc rights are protected.
