Legal Question in Workers Comp in California

I have been on the workers compensation system for almost 6 years now..2 neck surgeries an lower back pending.i have an attorney for this but is like not having one at all.the insurance company keeps holding my drugs while i have to suffer for this ..lost my employment wasted all these years..i'm stressed out ,bipolar now,depression, suffering from pain and you name it?..getting no help from federal or state, emotionally not wanting to live now....i have been neglected with this system since the beginning.

Sorry to read about your difficulties. The comp system basically became defense leaning with the promulgation of sb863 where the code switched from "the employer shall provide medical care" to, "applicant has right to ask for medical care." This change has dessimated the workers medical.

The new law that went into effect January 2014 permits the insurance company to refuse your medication legally without the lawyer being permitted to challenge it (except for the worthless Independent Medical Review...and 90% of IMRs deny all treatment). COMPLAIN to your State Assemblyman, your State Senator and your Governor, THEY did this to you. The WCAB Judges WANT to award 'reasonable' medical treatment, but the Lawmakers your elected took that away and gave it to the insurance doctors and Maximus;;; and Maximus denies 90% of treatment requests no matter how the lawyer argues for you. If we all actively campaigned against all the state officials in power, we'd have a chance for change. Instead, people just overdose on their medication and go to sleep or kill themselves instead of banding together as a voting block. YOU WRITE to each state elected official and promise to actively campaign against them in the next election because they voted to let you suffer.
