can right of rescission apply to an apt. rental?

There is no buyer's remorse period for an apartment rental, unless it is written into your lease.

If you need to get out of the contract, let your landlord know immediately and see if you can negotiate a graceful exit. It is possible that if your reason is compelling enough the landlord will let you off the hook.

If not, the extent of your liability will depend upon whether you signed a month-to-month agreement, or a year-long lease.

Also, the landlord has the responsibility to try to re-rent the apartment. If the landlord is able to do that at the same rental rate you would pay, your liability is for the period the apartment is unrented, to the extent of your lease. If the apartment can only be rented for a lesser rent, you will likely be responsible to make up the difference, also to the extent of your lease.
