Legal Question in Criminal Law in Colorado

Child Pornogrpahy Questions

I recently had my computer seized after being accused of running a FTP (similar to internet) site with child pornography on it. The seizure happened in January, the alleged incident happened last august and nothing has happened since then, I was told that charges would be filed within 2-3 months, but it has been much longer. My life is on hold, and waiting is the hardest part. I have a few questions please. This case is federal

1. What is the statute of limitations for charging me with possession or distribution of child porn? and generally, how long does it take for charges to be filed, after the prosecutor has all the required evidence.

2. If the pros. att. is willing to offer a plea bargain, what are the lesser crimes I can be charged with?

3. For sentencing, is possession of child pornography considered a sex crime? and if convicted, will I be required to register on the sex offender database.

Re: Child Pornogrpahy Questions

There is plenty of time on the SOL. Plea bargain time comes after the filing of charges. Sex crime - yes.

These charges should be taken very seriously - get an attorney ASAP.

You are now in the eye of a legal hurricane. It is not at all unusual for the Feds to wait many months before indicting defendants on cases of this sort. We have handled MANY cases accross the country exactly like this one. YOU WILL BE CHARGED! Please call us first thing Monday PST to speak with an attorney about defending you against these charges.
