Legal Question in Criminal Law in Colorado

I have court tomorrow. Last year the judge said that he was giving me one year unsupervised probation 180 days with 170 suspended as long as I stayed out of trouble. Well I stayed out of trouble for 8 months I did everything else that he told me to do. I only caught one new case in August. But since August I been on probation in a different county and no new cases. Is there any way that I can ask the judge to run the jail time with my probation I don't want to b in jail for Christmas I have a 1yr old daughter I been struggling with homelessness and I'm finally turning my life around n going to jail is just setting me back from everything

Yes, you can always ask the judge to not give you jail time. However, the judge will view it as a violation of probation and make a decision. The judge will consider various factors like criminal record, the present case, new charge, employment, etc. I would recommend bringing in proof of everything you have done on the case. If the judge does elect jail time you can ask for work release or in-home detention (although rarely given). You can also request the time to start after Christmas. Each jurisdiction can be different as well as the judges.
