Legal Question in Criminal Law in Colorado

reconsider/sentence

my boyfriend was sentenced to 16 months county jail. the judge wouldn't give him a plea agreement with a deffered judgement. so they came up with putting a false misdameanor charge on with it so he would do some jail time. he ended up getting the max sentence. he requested then and is still requesting work release but was denied. he already tried for reconsideration but they wont even give him a chance. but there are people there on more charges then he got and they only recieved 6 months to the most. he's been there 8 months already and we dont know what else to do!!!! what should we do?????

What jail is it?If he has actually been in custody continually for 8 mos, with good time and earned time, he should have served the sentence. Something else is up. Perhaps the conviction is faulty. If so, appeal or 35c may work. Also, talk to his case manager. If the sentencing court will not give him anything on reconsideration, the sheriff's office might.

As criminalist Dr. Henry Lee would say, "Something wrong."

Ordinarily, you wouldn't have to do anything: most people would be walking having served half their time. Talk with the court or the jail and ask what's going on. If you don't get a satisfactory answer, you may have to hire a lawyer or investigator to work on your problem.
