Legal Question in Family Law in Colorado

How do I go about a child custody case my four year old has been in my custody full time and her dad is taking me to court for joint custody when he has been incarcerated for the majority of her life and is also claiming I am in contempt of court for not allowing four hours of visiting time. What should I do?

The best thing to do would be to hire an experienced family law attorney to represent you.

If that is not possible, you will need to review what he has filed. If there is actually a contempt order pending, you will need to be prepared to explain why you did not follow the court order or seek to have it changed and - ideally - demonstrate that it was impossible to do so. You will also want to ask the court to enter appropriate parenting time orders which probably do not involve overnights for the father until he goes through a reintroduction period and demonstrates his ability to appropriately care for the child.
