Legal Question in Civil Litigation in Colorado

Getting Arrest Record Sealed

I was arrested for a failure to appear in court. The arrest was doing to not having my insurance card in my possession. The case was dismissed, my question is how do I fill out the form JDF 417 (24-72-308 C.R.S.) Moreover, where do I file the petition? I was arrested in Arapahoe County but the warrant was from Weld County. Any help would be appreciated.

Thanks

Re: Getting Arrest Record Sealed

Hello:

A good place for information regarding the sealing of an arrest record can be found at the website location of http://www.courts.state.co.us/chs/court/forms/sealingofrecords/jdf416.pdf. This site should detail most of the procedure for you.

You also need to get a copy of your CCIC criminal history. You can obtain this at the police department or sheriff's office in the city or county where you live. File your case in Weld first and see if you can get the judge to seal the Arapahoe County record too. The judge has statewide authority and he should be able to do this. If he won't (or can't) then you will also need to subsequently file in Arapahoe County.

Good Luck. If I can help you in the future, please feel free to contact me.
