Legal Question in Civil Litigation in Colorado

Can a private Attorney prosecute a misdemeanor

A person violates a State Statute which is classified as a misdemeanor, punishable by up to $1000 fine and/or 1 year imprisonment. Can the Attorney I hire ''put them away'' as the saying goes ??

Not unless they get appointed as a special prosecutor by the judge and DA - even then I am not certain that there is a statute that allows that. I doubt there Court or DA would do that. Your private attorney could file a motion to compel prosecution and privately investigate the case to make sure the evidence is there and turn that over to the prosecution.
