Legal Question in Personal Injury in Colorado

Gross Negligence

In a medical building restroom, the cover of a toilet tissue recepticale fell and hit me in my temple. The cover was held together with tape. Notified the building mgmt company, they took injury report, I went to the emergency room to be checked out, used my medical insur, had a headache for a couple of days. My Insur paid there part and I have received bills for my portion of payment. It has been a month not a word from this Mgmt company, except total run around. Contacted a lawyer and was told didn't have a case because I was not ''injured''. Is there gross negligence on there part for the cover falling and responsibility for my medical bills. How do I handle this.

It does sound like negligence, but unless the medical bill is greater than $7500, it sounds like a suit in small claims court, where attorneys rarely venture.
