Legal Question in Traffic Law in Colorado

The ticket I got in Fountian, CO is for as i quote "Careless Driving, subject drove too fast for conditions while splashing a pedestrian on a side walk". Thiswas on a strait road after a big rain where there was a lot of water on the road everywhere. This took place on the 4th of July and of course I'm in the military. The defense Atty gave me the option to pay the fines but would take the points away (which doesn't seem right). I feel that this ticket is unwarrented in different ways. What kind of legal arguement could I present in court.

The fact that you splashed water does not create an offense if the drainage system in fountain is inadequate for conditions.
