condominium bylaws

we purchased a condo. The roof

leaks. the roof covers our unit and a

unit under us. the condo assoc

would not pay for roof despite bylaws

stating they are responsible for

maintaining building envelope. we

had to replace the roof or suffer more

damage. who do we sue to recover

funds? the unit owner below or the

condo assoc?

Your answer completely depends on the by-laws and what is contained within them. If it is the responsibility of the condo association to fix the roof, and you requested such repairs be made, and they refused, and you personally paid for the repairs, you may be entitled to sue the association for repayment. But again, I would need to look at the appropriate documents.
