child support/divorce agreement

My ex and i have joint custody of our 2 kids, now ages 18 and 16. at this time they live w/ him, so i pay child support, however our divorce decree stated that he had custody of my son and I our daughter. and also that he'd pay me child support and alimony. i want to go back to this arrangment. what do i have to do?

Re: child support/divorce agreement

You would have to file a motion to enforce the decree. It appears that you accepted and agreed to this new arrangement, so I am not so sure a motion for contempt is appropriate. (this means you are alleging that he is in violation of the decree)Therefore, you would request that the decree would merely be enforced by its terms.

If either of your incomes have changed substantially since the decree, those terms could possibly be modified by him if he requested modification. This means he could ask the court to modify the terms and enter an order requiring you to pay child support just as you have been doing.

Regarding alimony, I'm not sure what the decree says so I can't comment on the possibilities.
