Relocating to another state with my children

I have just moved to Delaware from Florida. Our lease is up here my husband got a job here. He is abusive and I do not have a job here. I want to go back to Florida where there is my family for help. May I relocate? What do I need to do first. I do not want to be classified as kidnapping my children.

I don't know how long you have been in Delaware. If less than 6 months, Fl may still be able to assert jurisdiction. Check with a Fl lawyer to see if you can bring a custody action in Florida. If not or you prefer Deleware the procedure is to file a petition for a custody order and motion to relocate to another state.
