Legal Question in Immigration Law in Delaware

My boyfriend is being held in a correctional institution for traffic violations and criminal impersonation (he gave the officer a false name out of fear of being deported then later gave the correct name). He has an immigration detainer on him, but has $250 unsecured bail. If I pay the bail will he be released or will he need to wait another 72 hours for immigration to pick him up?

This bail, I understand, applies only to his criminal offinces. Therefore, f you pay this bail, he will not be released. He will be transferred into ICE immigration custory, and then will have a hearing in front of the immigration judge. Immigration bond is usually much higher - on average $2,500 till $10,000. Not everyone can be granted bond. If he is not your husband and has no close relatives who are US citizens or permanent residents, he might be considered a flight risk and held without bond or bond could be very high.
