Legal Question in Traffic Law in Delaware

Police officer misled me into speeding.

I was stopped for speeding in Sussex County (52 in a 40). I was leaving Ocean City, houses were thinning out, I was thinking the speed limit would jump to 55 soon. A police officer passed me, going about 55 mph (without his lights on)...I assumed the limit was 55, so I started to speed up. As soon as I sped up, another officer turned his lights on behind me. As soon as I started to pull over, the officer who had passed me going 55 slowed down, made a U turn, and drove slowly the other way. I plead not guilty, because I believe it is unjust the way I was stopped. Any advice?

Re: Police officer misled me into speeding.

Although an explination as to why you were sepeeding, it will not be enough for the judge ( who I have appeared before )to dismiss the charge.

However, if you have a good driving record ( no moving violations, or 1 or 2 but none recently,)

he may allow you to take a defensive driving school and, upon completion, dismiss the charge.

you should bring a copy of your record to court.

good luck.
