Legal Question in Wills and Trusts in Delaware

discovering what is in the estate

My sister is executor of our mother's estate. She removed funds from an overseas account and placed the money in her personal account before transferring it to the estate account. The lawyer for the estate will not talk to me. How can I find out the true value of the overseas account, and does the estate lawyer not have to disclose anything to me even if I am an heir?

Re: discovering what is in the estate

If the Will names you as a beneficiary then the attorney handling the estate must inform all beneficiaries of the assets, debts and disbursements. If the executor is wasting the funds from the estate and it has nothing to do with the probate then you can file a motion to have that executor removed and a new one appointed. For a copy of all documents filed with this estate contact the County Court, Probate Division in the county where your mother resided and request a copy of the file.
