custody

an 11yr old wants to get out of mothers house and move to dads home. mother told her she could do this at age 12 .Can this child legally get out of living with mother? She is under a constant conflict in her mothers boyfriends home.

I don't practice family law, so do not have definitive answers. In general though, if the parents are separated or divorced, they need to either agree on who will have custody or get a court order. So if the child tells the dad that she wants to live with him and the dad is willing, the dad either needs to reach an agreement with the mom or go to court and get a custody order.

Of course, if the child is in danger in any way, the dad (or a family friend or relative)can and should go to social services or the police for help.

In either case, the dad should probably get a good family lawyer (call the Florida Bar for a referral) unless there is an agreement with the mom that he is content to follow.
