Is an agreement to repay employee relocation costs enforceable?

I was hired by my company in Jul '04 and signed an agreement to repay relocation costs if I leave the company prior to 2 yrs of service (as well as a separate agreement to repay a sign-on bonus). If I choose to leave, am I obligated to repay these amounts, or does my company need to take formal legal action (i.e. file a claim) against me prior to repaying? I am truly attempting to ascertain if these types of agreements are actually enforceable by law or if they are more so used as 'scare tactics' to prevent new employees from jumping jobs to frequently. In addition, if I relocate to a new state, does my current company need to take action in my present location, or in my new location?

Either State would have jurisdiction to hear the cause. Without reading the agreement, I cannot venture an opinion on its enforcability.
