Legal Question in Business Law in Florida

Intentional harm of a business

I received unsolicted faxes in multiples of three for many months from a chamber of commerce. I called and faxed them requesting that they remove us from the automatic fax and told them each fax came over 3 times in a row. They never stopped. Today they sent 3 faxes again and so I sent a cover fax and a copy of all 3 of their faxes back telling them to stop sending this and I faxed it about 5 times so they would hopefully pay attention. I have a voice mail back saying that what I did was illegal and they are pressing charges and that the damage is extensive. (I did this on a holiday because I knew they would not be open). Is that true and what can I do considering they would not stop sending the unsolicited faxes to me?

Thank you.

Re: Intentional harm of a business

I am not aware of anyone going to prison for returning a fax by fax 5 times to the sender. Save the ridiculous voicemail so you can laugh at it from time to time. I am also not aware of any law that you have violated and I cannot imagine that the State Attorney's office is going to vigorously pursue you for your harmless antics. The mere fact that the chamber of commerce has completely ignored your repeated requests to be taken off of its fax/mailing list would suggest that the chamber is either intentionally ignoring your requests or not receiving your messages. If it is not receiving your messages, then naturally sending your fax five or six times to ensure that the request was received by the recipient would not be outrageous by any stretch of the imagination. If it is ignoring your requests, then perhaps having received your fax five times will encourage it to stop ignoring your repeated requests. If any claim or charge is made against you, seek the advice of counsel. Good luck.
