Legal Question in Civil Rights Law in Florida

child biting

I would like to know if I have any legal rights as a parent of a child who has been repeatedly bitten by another child at a daycare? I have addressed the parent of this child in the past and has been going on for over a year. Just this week my child has been bitten three times, once in the face hand and back I am afraid of scars and other damage it will do to my child. The daycare says there is nothing they can do to the child except time out.i have asked to have this child removed from the daycare and they say its not thier policy. I don't want to have my child suffer by removing him he has been there since he was 6 wks old and is now 2.
