Legal Question in Civil Rights Law in Florida

defamation of character and slander

I am the victim of defamation of character and slander from someone that I am living with in a common area. This person has made false statements about me within the building where I live as well as the area in which I live. I would like to press charges against this individual. I also have been doing alot of research on the subject and learned that a charge like this is a civil charge. I read that if the person has said things that state that I have done something I can be convicted for, I can charge him criminally instead of civilly. Also, any attacks that I may receive because of his slander (physical or not) I would also like to charge him for and make part of the case. Is this possible as well? I also filed a formal grievance against this person under the policies of the place where I live and they have not responded, breaking their own policies. Can I charge them as well?

Re: defamation of character and slander

You cannot file criminally. It is a civil suit for defamation. Alot also depends on whether the person who defamed you has assets to recover in the event you win a judgment. If you would like to discuss a consultation, please call my office.
