to appeal the judges order

to deny defendant's counter

suit.

You really need to see a lawyer. The notice of appeal is filed with the court, but there are rules of appellate procedure that govern any appeal and lay out what is required. I am not even sure if an order denying a mnotion to permit the filing of a counterclaim is something that can be appealed until the entire case has finished. You might even be able to file the claim as a seperate suit. There are not enough details to provide you with any meaningful guidance. I know this is the third or fourth question you have posted, but you should see a lawyer. Your issue is not one that can easily or accurately be answered on a board like this.
