Truck Rental

I rented a truck Jan 06. The truck had brake problems and we had to leave the truck at our house to be picked up by the co. Company was upset that they had to pick the truck up and told us that we should wait to have a mechanic come by and look at it-time constraints prevented us from doing this. I disputed the charge on my credit card and the dispute was in my favor. Today, 6/06 I received a package in the mail for a claim of $3000+ for repair charges. I refused the insurance waiver from the co. and they are demanding payment for body repairs on the truck. When they picked up the truck, the only person at the house was my mother-in-law, who did not get anything in writing stating the condition of the truck. We did not cause any damage to the truck and I think they are just upset because the fact that we refuse to pay for the rental. How would you suggest I proceed with this.

Request "in writing" copies of every document showing prior rentals from the time the truck wsa purchased to the time that it went to the body shop to see if the damages they were claiming were ever noticed or marked off on previous customer invoices. Request copies of the repair charges. Request photographs of the damages. Request dates of when the photographs were taken. Request anything else that you can think of to show that the damages were not there when you had the vehicle. You may also wish to depose the person that picked up the vehicle. IF you still need assistance, then hire an attorney that is local to you, but understand, that any fees you pay an attorney are likely not recoverable.
