Legal Question in Credit and Debt Law in Florida

Collections

I received a call yesterday from Michael Husjy at (305) 407-9697 from United States Legal Department, he said that a comapny Midland marketing who I took out a web loan in 10/06 for $200 and paid back $300 in 2/07 has filed a legal complaint against me for fraud activities, he wants $450 from me - $250 tomorrow and $200 in two weeks. I am a single parent with only me income to rely on and he will not discuss any futher payments, he said that I need to be very afraid and get care for my daughter because I will be arrested if it is not paid by tomorrow -I am to call him and get wetern union information. I have called Midland Marketing (800-783-4936) and they cannot help me. I have called and left 4 messages to I-Collect(866-856-1024) who bought my account from Midland and no one from there has called me back. Can you tell me if this is actually a department of the united States and legal or is it a collection agencies? I called information and the # and name are not listed and I looked in the Better Business Bureau for the comapny and nothing. I do not feel that I owe the money but cannot afford to get in trouble and need some help & advise immediately. I am honestly afraid to leave my daughter and go to work. Please help.

Re: Collections

He cannot arrest you. If they have a claim they have to sue you. If I were you I would write a certified letter, return receipt requested saying you dispute the bill and that pursuant to the Fair Debt Collection Practices Act, the collection company is to cease all communications with you. This sounds like an unscrupulous collection agency trying to scare you. If your letter does not work, you may have a legal claim against the collection agency under the federal statute I cited. Send your letter and if you have further problems, feel free to contact my office.
