filing a lawsuit

If someone agreed to repay a $6000 loan by a verbal mutually agreed upon date and they did not repay. They have also refused repeated requests by the lender to pay back the loan. The lender lives in Florida and the person who received the loan lives in New Jersey. What is the most appropriate type of lawsuit to file (criminal, grand theft, or civil)? In which state should the lawsuit be filed?

Civil suit in NJ. Without poof you are wasting your time.
