Legal Question in Criminal Law in Florida

my fiance was on probaton and got arrested for battery. i dropped the charges but he still in jail. court date not until the 5th of next month. my question is do they give u bond on a vop or do u have to stay in jail until the court date?

A person is not entitled to a bond on a VOP but that does not mean that they can't get one if requested. A motion for bond needs to be filed and a hearing will be set (usually within a week). If your fianc�'s attorney can give a good reason, the judge can grant a bond, but it is in the judge's discretion.

Most cases, whenever a defendant is on probation and they pick up a new charge, even one that you do not want to pursue, the court will keep them on a "no bond" status. Every judge is different though and if the state (not you) has dropped the charges, it may be easier to get a bond, but even then it is discretionary with the judge.
