Question:My boyfriend get arrested on 8/5/09 for drug trafficking >200 <400, I was told that if 33 days pass and the state don't take the case, a motion is filed and he is set free. Now it's going to be 33 days in 9/7/09 and they set a court session for 9/17/09. Does he still can get that 33 days motion or not?
Answer:Yes, he still gets his motion if they miss the date for filing charges.
New Question: I check on the county clerk online and it's said that they filed information on 9/3/09. Does that's means that they filed the charges on that date or that they filed the plea of no guilty on that date???
