Legal Question in DUI Law in Florida

DUI charge in Florida

I got my first DUI conviction 3 years ago in New York with my florida drivers license, then recently I got another DUI in the state of florida with a suspended Florida license due to the prior conviction. Being that the first one was in New York can I be charged in Florida as a second offense?

Yes. You can, and most likely will, be charged with a second DUI offense "within 5 years" which has a mandatory jail sentence and a boat-load of other penaltis. If I can be of any assistance, please let me know.

Yes. Florida DHSMV and state courts are "on-line" with most other states and observe out of state convictions. You have multiple issues that need addressing by a qualified attorney in your area including, vehicle forfeiture, HTO habitual license status, mandatory jail upon conviction, etc.
