DWLS on a marijanna dui

Will I go to county or what? I got this on my way to my first meeting with my PO

You might.

The system doesn't look favorably on DWLS's which stem from a DUI.

The prosecutor and the judge will often be thinking that they told you not to drive and you didn't listen so a tougher punishment is necessary.

Probably should get an attorney on this one, cost shouldn't be as high as it would for a DUI.

I read your question and the one response. I cannot give you a definite answer without knowing all the facts of the new case and whether or not this is a first DUI. I can say if you can drag out the susp. license case until you can come in with a good license (if that option is possible), it will tempt the State and the Court to reduce the charge to No Valid license and only seek community service and a fine. I just handled a case like that for a client in St. Johns Cty.

I agree that you might go to county jail. I also agree that the system doesn't look favorably on DWLSR's on a DUI suspension. I don't necessarily know if I agree with the "drag it out" strategy. Driving to your probation meeting, while having a suspended license, is really not a good idea. The State will most likely seek a jail sentence based on the poor judgment used in picking up the new offense. Depending on how many prior DUI's or DWLSR's you have, you will want an attorney to review your case to make sure you don't get "habitualized." That can happen even if you resolve the case with a county jail sentence.
