Legal Question in DUI Law in Florida

plea agreement

I plead to a dui (2nd outside of 5 years) It was a state offer. Once the agreement was signed and sent to the state, they came back asking for additional penalties. Is it legal for this to be done? Didn't we have a contract in place?

Re: plea agreement

If the agreement you wrote about is a document entitled "Plea in the County Court", what is on that document should be the only penalties that you will be held to.

You should consult with your attorney immediately to determine what is expected of you.

Re: plea agreement

If the Court has accepted and you have been sentenced, then Jeopardy has attached and the State cannot enhance the sentence.
