Legal Question in DUI Law in Florida

I have a question I need answered. My husband was charged with a DUI. The police gave us fifteen minutes to come retrieve our car. My nineteen year old daughter took an Uber to get our vehicle. The cops put the two mini bottles of alcohol in our trunk. One of which was opened, seal broken. My daughter drove our car home. Now, my question is.. Was it legal for the police to not check my daughter's ID and let her drive home with alcohol in the trunk? By the way, the trunk is accessible from the back seat. We live in the state of FL.

There is no duty for the police to check ID. It may be the responsible thing to do, but there is no law requiring it.

You ought to be focused on your husband's drunk driving case than the open liquor in the trunk. Be thankful that they let you take the car home and not force you to pay towing and storage fees.
