Legal Question in Elder Law in Florida

Geriatric care for my dad

My father has severe Alzheimers and must be put in a home. My mom and dad both live in Miami FL. My mother receives restitution from Germany as a holocaust survivor. They have a condo (value apx 200K) in Miami. They have some other cash in CD's and the bank. They receive social security (he's 87 and she's 80). She didn't work so her SS income is low. What can we do to have medicaid pay for my father's long-term care? What can we shelter from being touched by the government?

Re: Geriatric care for my dad

Generally speaking since dad is already in need of 24/7 care your options are going to be very, very limited. I believe mom's Holocaust Reparations are exempt from the income rules, but you really need to see a Florida elder law attorney and go through the Medicaid application. They'll be a person at the nursing home too who will help you go through the application.

Good luck.

Re: Geriatric care for my dad

This is a real problem. Especially the condo which has a $200,000 value. Does it contain a mortgage which would bring down the equity?

Medicaid will pay only a certain amount, and does not cover the full amount of his care.

Even with the restitution from Germany as a holocaust survivor, and with his social security, it would not be enough.

I don't have enough information as to the resources of your parents, to make an intelligent answer to your questions.

If you would like to contact me, and give me some additional information, perhaps I can help you.

Don't wait too long, especially if your father cannot remain at home.
