Legal Question in Elder Law in Florida

marriage and Medicaid

My companion and I own a house in FL 50/50 ''with right of survivorship''. He is going into nursing home soon and is running out of money, hence Medicaid. He wants to get married so I would collect his pension if he should die. Is this a good thing for me or would I be better to stay single because of Medicaid? I have more money than he does and don't want to lose any because I might need Medicaid some time myself. Am I in danger of losing the house if stay single? Please tell me which way is best for me, Is it worth all that goes with marriage just to get his pension? He is 84 and I am 75. Also, his daughter has his DPOA. Would I have to take that responsibilty if we marry?

Re: marriage and Medicaid

There are advantages as well as risks with either choice. The things you should consider are far too lengthy to include in this email response. You should consult with an attorney in your area who has a Medicaid practice. I am in Pinellas County and would be happy to meet with you. If you are in another area, please find an attorney with a Medicaid practice to consult with.

Best wishes,
