Legal Question in Elder Law in Florida

My mother died in 1995 & everything was left to my daughter & I. My daughter lives in my mother's house. There is a wooded vacant parcel of land down the street (approximately 3 acres). I want the vacant parcel sold & also want my daughter to buy me out of my half of the house. She is refusing to fulfill any of my wishes. What can I do? I am 77 years old & need the money now.

you will have to file a probate on the death of your mother. Then you can ask the court to partition the property - which they can not divide a house, and they will more than likely require the house to be sold. As to the land, they will divide the land in half.
