Legal Question in Entertainment Law in Florida

Entertainment law ?

We are a entertainment company and we booked an artist for a concert recently, we were expecting 4,000+ fans and we got a total of 1,500 (ish) fans, the saturday after the show we found out that the band was going to be somewhere else in concert in our same city and they were advertising it before we even started our promos, the never let us know they will be performing in the same city we would have never booked them.. What can i do and what do you recommend..Thank you

Re: Entertainment law ?

Whether you have any recourse will depend on your contract with the band. If your contract required disclosure of other bookings that would reasonably compete with your own, the band may have been in breach of your contract, and you may be able to recover damages. If your contract did not restrict competing performance dates, or atleast require notice of such conflicts, you should have your attorney review and modify your standard booking contract and chalk this one up to a learning experience.
