Legal Question in Family Law in Florida

American mother/german child right to take to U.S.

I am an American woman that married a German man in Florida. We moved to Germany 9 years ago after he lived with me there 5 months. We now have a bi-lingual 6 year old daughter. As a result of his committing adultry we are legally separated 1 1/2 years. The child is in my care and I want to know if I should divorce in Germany or in Florida so I can have a better chance to win the right to take her back to the US.She has no US passport yet.Since the separation he is not supporting us enough to survive.I sing part-time but it is not enough and I would be able to support her in the states when I could have an english speaking job.I want to know what my rights are in taking this action to move back to the US.

I do not know the laws in Germany. You must reside in Florida for 6 months before Florida would entertain a divorce proceeding.
