Legal Question in Family Law in Florida

i asked my wife for a divorce. she left the home and made residence elsewhere and her belongings have been removed. her name is not on my lease or any utilities. she has been gone for more than 5 days. do i have to let her back in?

Unfortunately, yes (if she comes back). It's considered the marital home regardless to her name not being on the lease. Just pray that she doesn't return until the divorce is granted.

you need to file for divorce and file for a petition for temporary needs. That way the court will give you permission to remain in the leased unit and then she will not be able to come and go as she pleases.
