Child Custody

Hello. I share 50/50 custody with my ex-husband. I recently got charged with theft. Can my ex-husband use that as a reason to tak efull custody of the kids? He has no other reason to justify it.

If by "take full custody," you mean that you'll lose all decision-making authority regarding the kids, I wouldn't bet on it.

If by "take full custody," you mean that you'll lose your 50% and you'll get stuck with the every-other-weekend deal, then maybe, but I wouldn't bet on that, either. Still, it's a definite possibility, and the father doesn't need any other reason to justify it.

If he files, get a good lawyer. And get another good lawyer to beat the theft charge.
