Children

My exwife just moved to NY to go to school. Leaving are 2 sons with her Mother. She was going to let them come with me until she found out she would not be getting child support. At that time she informed me she did not want to move them from there natural enviroment. What rights do I have? what would be my next step?

Petition the court to have them stay with you and revoke child suport.

Initially check your divorce documents regarding any provision about a parent moving more than 45 miles or out of state.

You should have a preference over anyone but your wife for the children to live with you. However, you will probably have to go back to Court to change the residence of the children and to get child support.
