When does commonlaw marriage apply?

I am presently living in MO with my girlfriend. I have stayed with her for 7 years only for the sake of the 2 kids that we have together. If my information is correct, I found out that commonlaw marriage does not exist in MO. I am planning to move to FL to find a better job. I understand that commonlaw marriage exists in FL. If I move with her, will we be instantly married due to my past 7 years together with her, or do I have another 7 years before commonlaw is enforced in FL?

I am not sure where you got your information but Florida has not recognized common law marriages for many years. Although at one time, Florida law did provide for a common law marriage, it was abolished over 15 years ago.

There is not need to worry. In order to get married, you must apply for a license and have the old fashioned ceremony, either by a clerk, religious official, or other authorized official (i.e. notary public).
