Legal Question in Family Law in Florida

My daughter has finished high school and turned 18 three weeks ago. I have been paying child support through payroll deduction. My daughter lives with her mother in Colorado. How do I go about suspending the child support? Do I need to see an attorney to accomplish this?

Depends on what you Dissolution of Divorce states. If you are paying until she graduates highschool then contact the Child Support Enforcement Division in Tallahassee - have them pull your file and if there is no back support, then will explain the procedure to you.

The safest best is depending on whether or not this is a family matter through dissolution of marriage or an action that was opened up with child support enforcement. If this was an order entered through your final judgment of dissolution of marriage, if both of you are in agreement, you can submit an Agreed Order Terminating Income Deduction Order, which you would have to submit to the Court for entry and then to your job for execution. If it's a child support matter, then you would need to file a Motion to Terminate Income Deduction Order and see if Child Support Enforcement will agree to entering same. They usually do if the mother agrees and there are no monies owed to the State. Let me know if I can be of any further assistance.
