Legal Question in Family Law in Florida

divorce

my spouse has been incarated or in prison for 8 years. We have 2 minor children will I be able to file for a uncontested divorce. Where would I file it. I recently moved to Florida but I resided in Texas for 6 months? Could I still file in Texas or in Florida

Re: divorce

You can file in Florida if you lived here for six months. However a Florida court could not divide any property the two of you held in Texas, unless he waives jurisdiction.
