Legal Question in Family Law in Florida

my soon to be exhusband has resently gotten in to trouble with the law he's gotten some battery charges on him one includes battery on a leo. i have an attorney through legal aide and she dosnt seem to think this is a big deal im wanting to get custody of our two year old daughter because of this but like i said my attorney dosnt seem to think its a big deal im concerened with my childs well being in his care being that she was at the home when all of this accured he was throwing a tv and pushing over a dresser we had a temporary aggrement with time sharing until he got in trouble he is suppose to get her on wednesday according to the temporary aggrement i need to know what i should do because im worried about my daughter going over to her dads and her saftey over there
