Legal Question in Family Law in Florida

Do my fiance and I have to be married before he can adoot my son. We are in the state of Florida the bio dad said he will consent. The bio father hasnt been in my sons life for 5 years now

I think it would be prudent for the fiance to wait until you are married to each other. Otherwise, you will have to give your consent to adopt to the fiance as well as the bio dad thereby leaving you no rights to your son.
