Legal Question in Family Law in Florida

How do I fix it?

Please, please help us! When I was younger I became pregnant with my first child. I knew the person that I was with for maybe 3 months at the time. After he found out that I was pregnant we broke up just to get back together and-marry when I was about 6 months pregnant. He moved his things into my home, but he only stayed there maybe 5-6 days before he left me for good, 3 weeks after we married. I never saw him again. I had my child, went to college, worked and try to make the most of it. Never even thought about him. He told me when he left he was going to divorce me. I could not find him to know for sure. I remarried 4 years ago. He is the father of both of my kids. Please help me I don't know if the marraige is legal? How can I make it that way? I need some help. I don't want this hanging over us any longer. He wants to adpot my daughter. please help us.

NOTE: This communication is not intended as and should not be interpreted as legal advice. Rather, it is intended solely as a general discussion of legal principles. You should not rely on or take action based on this communication without first presenting ALL relevant details to a competent attorney in your jurisdiction and then receiving the attorney's individualized advice for you. By reading the "Response" to your question or comment, you agree that the opinion expressed is not intended to, nor does it, create any attorney-client relationship, nor does it constitute legal advice to any person reviewing such information, nor will it be considered an attorney-client privileged communication. If you do not agree, then you are instructed to stop here, and do not read any further.

You need to try and locate the father and try to ascertain whether or not he ever obtained the divorce. You may also check the county records either in person or online if available.

If you have not gotten divorced, you have actually commited the crime of bigamy. It is against the law to marry another while still married to your original husband.

If your first marriage is still intact, then you need to get a divorce and then get married to the man you now consider your husband. Frankly, you may not be legally married.

I strongly suggest that you meet with an attorney to review the specifics of your situation and explain how you can resolve your problems.
