Under Florida law, if you were not married to the mother, until a court addresses parental responsibility, you basically have no rights to the children. However, you still have the legal obligation to support them. You need to promptly pursue your paternal rights. Once the court case is filed, there is not supposed to be any preference of the mother over the father. Contact my office to schedule a no obligation office consultation. I practice family law through-out the Great Tampa Bay Area. Good Luck.

If you were not married when the children were born, she technically is considered to have superior rights to the children right now. You will need to establish your paternity of the children through the courts.

You should speak with a family law attorney in your area to discuss your options as soon as possible.
