Legal Question in Family Law in Florida

My ex husband is $10,000 behind in back child support and $5,000 behind presently. Our divorce papers state he is responsible for half of our children's medical bills and if he should fall behind in child support his income tax return will be applied to his back child support. He filed his taxes and is projected to get $3945 back. I spoke with Child Support Enforcement and unfortunately his return will not be intercepted this year because they didn't have anything in place with the IRS. He stated to me on the phone that he knows it's supposed to come to me but that "let's face it, I'm not going to screw myself out of money." My ex husband also enters into written agreements to make sure he can keep his license valid but never sends in the correct amount he agrees to pay to catch up the afore mentioned $5,000 in arrears. I have a Child Support Modification court date for March 30th. What can I ask the judge to do about the matter?

Ask the Judge to enforce his Order as to the Tax refund. Usually those orders apply to the IRS and to the individual.
