legal age of deciding which parent you choose to live with?

hi, i am 16 years old almost 17 and i moved to georgia with my mom and step-dad on may 27, 2005. my question is what age do you have to be to decide who you want to live with? i have a better relationship with my dad and am better off down there i have more of a life, including friends, family, and i like the schools better if you could answer my questions that would be great thanks

You indicated you were asking pursuant to Florida law. Since you have been in Georgia over six months, Georgia law likely applies. Children don't get to choose. However, if a parent files for custody, a child age 14 or other has a right to express a preference and the Judge will follow it unless he decides it is not in a child's interest.

However, since you are almost 17, this matters little. Unless both parents agree, in which case you could see a case completed in 1-2 months, a contested case takes far longer and by the time it's heard you could be at or near 18.

A simple answer might be to wait until age 18 and you can move at will then.
