Legal Question in Family Law in Florida

Modification of child custody agreement. Mom and dad had shared custody in Jacksonville, fl alternating weeks. Mom then left for military and dad moved to orlando with children to have support from his family since hers was unable to help. Dad kept children for a year and when mom returned she kept children for a year. Now that its dads turn they agreed on six months each. Dad has had the children for the summer and now the week before school mom took them back and now wants to follow the original agreement, but dad still resides in Orlando with his family and mom in Jacksonville with her family. Should dad petition to modify agreement for 6 months each now? or wait til he moves out. He just started a new job.

The last order of the court is still in place until it is changed so if you want it modified then file a supplemental petition.
